Ownership
All photographs taken by Perfect Moment Proposal Photography are protected by copyright under the Copyright Act 1968 (Cth) and remain the intellectual property of Perfect Moment Proposal Photography, unless otherwise agreed in writing. Booking a session does not transfer copyright to the client.
Client usage rights
Upon full payment, clients are granted a personal, non-exclusive licence to:
- Download, print, and share delivered images for personal, non-commercial use (including social media, provided the photographer is credited where reasonably practicable)
- Order additional prints or products through channels approved by us
Clients may not:
- Sell, license, or use the images for commercial purposes without written permission
- Edit, alter, apply filters to, or remove watermarks/branding from images in a way that misrepresents the original work
- Claim authorship of the photographs
Our usage rights
We retain the right to use images from your session for our own portfolio, website, social media, marketing materials, and competition entries, unless you opt out in writing prior to your session (see below). We will never sell your images to a third party for their commercial use without your separate, explicit consent.
Opting out of marketing use
If you'd prefer your images are not used in our marketing or portfolio, let us know in writing before your session and we will honour that request.
Model/client release
Booking a session constitutes agreement to our Model/Client Release below, which governs consent for use of your image.
